IMPORTANT NOTICE REGARDING ARBITRATION AND CLASS ACTION WAIVER

Acceptance of Terms
PLEASE READ THESE TERMS OF USE (“Terms”) CAREFULLY.
By accessing or using any websites, mobile experiences, career sites, application portals, SMS programs, or other online services operated by JEM Wellness Brands, LLC and its affiliated entities (collectively, “JEM,” “we,” “us,” or “our”), you agree to be legally bound by these Terms.
If you do not agree to these Terms, you may not access or use the Online Services.
You must be at least 13 years of age to use the Online Services. Certain services (including job applications, ordering, or SMS programs) require that you be 18 or older.
Scope of These Terms

Your use of the Online Services is at your own risk. If you are dissatisfied with any aspect of the Online Services, your sole remedy is to discontinue use.
Changes to These Terms
JEM reserves the right to update or modify these Terms at any time. Changes are effective upon posting with an updated Effective Date. Continued use of the Online Services constitutes acceptance of the revised Terms.
Use of the Online Services
All content made available through the Online Services—including text, graphics, logos, videos, software, layout, and overall design (the “Materials”)—is owned by or licensed to JEM and protected by intellectual property laws.
JEM grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Online Services for personal, non‑commercial purposes only, subject to these Terms.
You may not:

User Conduct

Any information, ideas, suggestions, or other materials you submit to JEM (other than personal information governed by our Privacy Policy) are considered non‑confidential.
By submitting content, you grant JEM a perpetual, royalty‑free, worldwide license to use, reproduce, adapt, and distribute such content for any lawful purpose.
Recruiting, Candidates, and Applications
Use of JEM career sites or application platforms does not guarantee employment. All hiring decisions remain at JEM’s sole discretion.
You represent that all information submitted in connection with an application is accurate and truthful. Providing false information may result in disqualification or termination of employment if hired.
Account Registration and Security
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
Notify JEM immediately of any unauthorized use or security breach.
Communications & Electronic Consent
By using the Online Services, you consent to receive communications from JEM electronically, including email, SMS, and platform notifications.
All electronic communications satisfy any legal requirement that communications be in writing.
SMS Terms
If you opt in to receive SMS messages from JEM, you consent to receive transactional, recruiting, or marketing messages via automated technology.

Third‑Party Links

No Warranties
THE ONLINE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
JEM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JEM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE ONLINE SERVICES.
Indemnification
You agree to indemnify and hold harmless JEM, its affiliates, officers, employees, and partners from any claims or damages arising from your use of the Online Services or violation of these Terms.
Mandatory Arbitration & Class Action Waiver
Any dispute arising out of or relating to these Terms or the Online Services shall be resolved through binding arbitration on an individual basis, and not as a class or collective action, except where prohibited by law.

Governing Law
